Terms and conditions of sale
They apply to every order placed on sapedeluxe.com. They are written to be read, not to put you off reading them.

This is a translation provided for convenience. The French version of this document is the one that legally applies: where the two differ, the French text prevails.
Article 1. Purpose and scope
These terms govern the sale of second-hand and clearance luxury fashion pieces by the company publishing the site sapedeluxe.com, hereafter « SAPEDELUXE », to any consumer within the meaning of the French Consumer Code, hereafter « the customer ». The company’s full identification appears in the legal notice.
Placing an order constitutes unreserved acceptance of these terms, in the version published online on the day of the order.
Article 2. Products
The pieces sold are second-hand or clearance luxury fashion items. Each one is described individually before going online: brand, model, size, colour, material, condition and observed signs of wear.
The photographs published are those of the piece actually being sold. The condition is described and every observed flaw is listed on the product page. Second-hand pieces may show signs of wear: these are stated.
Stock levels shown are real. A piece marked « one of a kind » exists in a single example.
Article 3. Prices
Prices are shown in euros, inclusive of all taxes. They exclude delivery charges, which are shown before the order is confirmed.
Where a boutique retail price is given for comparison, it is a public price observed at the brand, and its source and the date it was recorded are stated. It is never a former selling price applied by SAPEDELUXE.
The applicable VAT scheme is the margin scheme for second-hand goods, in accordance with article 297 A of the French General Tax Code. VAT therefore does not appear separately on the invoice: that is the rule for this scheme, and it makes no difference to the price paid.
Article 4. Ordering
Orders are placed as a guest. Creating an account is never a prerequisite to buying; it is offered after the order.
The sale is final once payment is received. A confirmation email summarising the order is sent immediately. SAPEDELUXE reserves the right to cancel any order in the event of a previous dispute, suspected fraud or an obvious pricing error.
Article 5. Payment
Payment is made by bank card, with 3-D Secure strong authentication. Payment in 3 instalments at no extra cost is offered from €100 upwards: one third at the order, the other two at 30 and 60 days, on the same card.
No card details pass through or are stored on SAPEDELUXE servers. Processing is handled by a PCI-DSS certified provider, whose name is shown on the payment page.
Article 6. Delivery
Orders are prepared within 1 working day and shipped by tracked and insured Colissimo, in France and across Europe. Transit takes 2 to 4 working days in mainland France, 3 to 7 working days in the European Union and 5 to 10 working days in the rest of Europe. An estimated delivery date is shown on every product page and in the checkout.
Delivery charges are €6.90 in France, free from €300 of purchases; €12.90 in the European Union and €19.90 in the rest of Europe, free from €500. They are shown before payment; no charge is added on the last screen of the checkout. Outside the European Union, customs duties and import VAT are payable by the customer.
Should delivery be more than seven days later than the estimated date, the customer may cancel the order and obtain a full refund.
Article 7. Right of withdrawal
In accordance with article L221-18 and following of the French Consumer Code, the customer has 14 calendar days from delivery to exercise their right of withdrawal, without having to give a reason.
SAPEDELUXE goes beyond that obligation and grants 30 days of commercial returns, with return postage at its own expense. A prepaid return label is included in every parcel.
The refund is made within fourteen days of the return being received, to the same payment method used for the order. It includes the original delivery charges.
The piece must be returned in its original condition, with its accessories and its original packaging where it came with any.
To exercise this right, an email to contact@sapedeluxe.com is enough: using a standard form is not required.
Article 8. Legal guarantees
Every piece benefits from the legal guarantee of conformity (articles L217-3 and following of the French Consumer Code) and from the guarantee against hidden defects (articles 1641 and following of the French Civil Code).
The legal guarantee of conformity applies independently of any commercial guarantee. For a second-hand good, it lasts twelve months from delivery, unless a more favourable agreement applies.
If the authenticity of a piece is disputed and established as non-conforming, SAPEDELUXE refunds the order in full, including delivery and return charges, with no time limit.
Article 9. Personal data
The processing of personal data is described in the privacy policy. The customer has the rights of access, rectification, erasure, restriction, objection and portability provided for by the GDPR.
Article 10. Disputes and mediation
In the event of a dispute, the customer first contacts customer service at contact@sapedeluxe.com. Failing an amicable solution within thirty days, they may use the European online dispute resolution platform free of charge (ec.europa.eu/consumers/odr). The publisher’s details appear in the legal notice.
These terms are governed by French law. Failing an amicable resolution, the French courts have jurisdiction.
